TERMS OF SERVICE (UK) – NOOD ONE

OVERVIEW
Welcome to nood one. These Terms of Service (“Terms”) apply to your use of our website and the purchase of products from us.

The terms “we”, “us” and “our” refer to nood one (the “Store”). nood one operates this website and online store, including all related information, content, features, tools, products and services (the “Services”). nood one is powered by Shopify, which enables us to provide the Services to you.

By visiting, interacting with, or using our Services (including placing an order), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use the Services.

IMPORTANT NOTICE
Nothing in these Terms is intended to limit or exclude your statutory rights as a consumer under UK law.

SECTION 1 – ELIGIBILITY, ACCESS AND ACCOUNT
1.1 Age requirement
You must be at least 18 years old (or the age of majority in your country) to place an order on this Store.

1.2 Account details
You may be asked to provide information such as your email address, billing, payment and delivery details. You confirm that the information you provide is accurate, current and complete.

1.3 Account security
If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. You must not transfer or sell your account.

SECTION 2 – OUR PRODUCT (SHILAJIT) AND INFORMATION
2.1 Product information
We make reasonable efforts to display product information accurately. However, images and colours may vary depending on your device and settings, and packaging may change from time to time.

2.2 Not medical advice
Any information provided on our website is for general information only. Our product is a food supplement and is not intended to diagnose, treat, cure or prevent any disease. Always follow the label directions. If you are pregnant, breastfeeding, taking medication, under medical supervision, or have a medical condition, you should seek advice from a qualified healthcare professional before use.

2.3 Availability and limits
We may change product descriptions, packaging, pricing, or availability at any time. We may limit quantities or refuse orders on a case-by-case basis (for example, suspected fraud or bulk/resale activity).

SECTION 3 – ORDERS
3.1 Order process and acceptance
When you place an order, you are making an offer to buy the product. We may accept or decline your order at our discretion. A contract is formed only when we send you an order confirmation/acceptance email (or otherwise confirm acceptance).

3.2 Payment
We must receive and process payment before an order is accepted and dispatched.

3.3 Cancellations
If you wish to cancel an order, contact us immediately at ant@loveux.co.uk. We will try to help where possible, but we cannot guarantee cancellation once an order has been processed or dispatched. Your statutory cancellation rights (where applicable) are set out in Section 6.

3.4 Personal use only
You confirm that purchases are for personal or household use and not for commercial resale or export.

SECTION 4 – PRICES, TAX AND BILLING
4.1 Pricing
Prices are shown in GBP (£) unless stated otherwise and may change without notice. The price charged is the price shown at checkout at the time you place your order.

4.2 Delivery charges and taxes
Delivery charges and any applicable taxes (including VAT where applicable) will be shown at checkout before you pay. If customs/import charges apply for deliveries outside the UK, these are your responsibility unless we state otherwise.

4.3 Billing information
You agree to provide current, complete and accurate purchase and payment information and to update it if it changes.

SECTION 5 – SHIPPING, DELIVERY, RISK AND TITLE
5.1 Delivery times
Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our reasonable control.

5.2 Risk
For consumer purchases, the product remains our responsibility (at our risk) until it is delivered to you or a person you nominate to receive it at the delivery address. If you arrange your own carrier that is not offered by us, risk may pass to you when we hand the goods to that carrier.

5.3 Title (ownership)
Ownership of the product passes to you once we have received full payment and the product has been dispatched, subject to Section 5.2 on risk.

5.4 Delivery issues
If your parcel is marked as delivered but you have not received it, contact us promptly so we can investigate with the carrier.

SECTION 6 – RETURNS, CANCELLATIONS AND REFUNDS
6.1 Our Returns & Refunds Policy
Returns and refunds are handled in accordance with our Returns & Refunds Policy. That policy forms part of these Terms.

6.2 Sealed goods (health & hygiene)
Because our product is an ingestible supplement, we do not accept returns of items where the seal/tamper-evident packaging has been broken, unless the item is faulty, damaged, or incorrect.

6.3 Statutory rights (UK) – faulty goods
If your item is faulty, not as described, or not fit for purpose, you have statutory rights under UK consumer law. These rights are not affected by our Returns & Refunds Policy.

6.4 Statutory cancellation rights (distance sales)
If you are a UK/EU consumer buying online, you may have a legal right to cancel within a “cooling-off” period in many cases. This right can be affected for sealed goods once unsealed for health/hygiene reasons. Details are set out in our Returns & Refunds Policy.

SECTION 7 – INTELLECTUAL PROPERTY
All content on the Services (including trademarks, logos, text, graphics, images, videos, and the overall look and feel) is owned by or licensed to nood one and is protected by intellectual property laws. You may use the Services for personal, non-commercial use only. You must not copy, reproduce, distribute, modify, or exploit any part of the Services without our written permission.

SECTION 8 – OPTIONAL TOOLS
We may provide access to third-party tools or services. These are provided “as is” and “as available”. We do not control and are not responsible for third-party tools. Your use of them is at your own risk and subject to the third party’s terms.

SECTION 9 – THIRD-PARTY LINKS
The Services may contain links to third-party websites. We are not responsible for third-party content, policies or practices. If you access third-party sites, you do so at your own risk.

SECTION 10 – RELATIONSHIP WITH SHOPIFY

nood one is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with nood one. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and nood one, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with nood one.

SECTION 11 – PRIVACY
Your personal information is handled according to our Privacy Policy. Shopify and certain service providers may also process personal information to provide the Services.

SECTION 12 – FEEDBACK AND REVIEWS
If you submit reviews, feedback or other content (“Feedback”), you grant us a worldwide, royalty-free licence to use, reproduce, publish, display and distribute that Feedback for operating and promoting our Services. You confirm your Feedback is accurate, lawful, and does not infringe third-party rights. We may remove Feedback at our discretion.

SECTION 13 – ERRORS AND OMISSIONS
We may correct errors, inaccuracies or omissions on the Services at any time, including after an order is placed. If this affects your order materially, we will contact you where reasonably possible.

SECTION 14 – PROHIBITED USES
You may use the Services only for lawful purposes. You must not misuse the Services, attempt unauthorised access, introduce malware, scrape content, infringe intellectual property rights, harass others, or engage in fraudulent activity. We may suspend or terminate access for breaches.

SECTION 15 – TERMINATION
We may terminate or restrict your access to the Services at any time if we believe you have breached these Terms or misused the Services. Sections which by their nature should survive termination will continue to apply.

SECTION 16 – DISCLAIMER OF WARRANTIES
The Services and product are provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee the Services will be uninterrupted or error-free. Nothing in these Terms affects your statutory rights.

SECTION 17 – LIMITATION OF LIABILITY
Nothing in these Terms limits or excludes our liability for:
(a) death or personal injury caused by our negligence;
(b) fraud or fraudulent misrepresentation; or
(c) any matter for which it would be unlawful to limit or exclude liability.

Subject to the above, and to the extent permitted by law, we will not be liable for losses that are not foreseeable, or for business losses (such as loss of profits, revenue, contracts, data, goodwill or opportunities). If you are purchasing as a consumer, we are responsible for foreseeable loss and damage caused by us.

SECTION 18 – INDEMNITY
If you misuse the Services or breach these Terms and that causes loss to us or others, you agree to compensate us for reasonable losses and costs arising from that breach, to the extent permitted by law.

SECTION 19 – SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remainder will remain in full force.

SECTION 20 – WAIVER; ENTIRE AGREEMENT
If we do not enforce a provision immediately, it does not mean we waive our rights. These Terms and the policies referred to in them form the entire agreement between you and us regarding the Services.

SECTION 21 – ASSIGNMENT
You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations under these Terms to another organisation.

SECTION 22 – GOVERNING LAW
These Terms are governed by the laws of England and Wales. If you are a consumer, you may also benefit from mandatory protections of the country where you live. Any disputes will be subject to the courts of England and Wales, subject to any consumer rights to bring claims in your local courts where applicable.

SECTION 23 – CHANGES TO THESE TERMS
We may update these Terms from time to time by posting a new version on this page. Changes apply from the date they are posted (unless we state otherwise). Your continued use of the Services means you accept the updated Terms.
